"A Frightening and Dangerous Nightmare"! Tesla may face class action lawsuit over 'ghost brake' defect
A Tesla Model 3 owner in California is suing the electric car maker in a proposed class-action lawsuit, according to reports, because his vehicle would suddenly Parking at nonexistent barriers, he called the problem a "horrific and dangerous nightmare".
According to a lawsuit filed by San Francisco owner Jose Alvarez Toledo, Tesla used unsafe technologies to get its self-driving cars to market as quickly as possible, including what the company calls Driver assistant systems for Autopilot or Full Self-Driving, as well as their emergency braking systems.
That has increased public and regulatory scrutiny of Tesla's driver-assistant technology, despite CEO Elon Musk's promise to achieve full self-driving by the end of the year.
"When a sudden and unexpected braking defect occurs, they turn an otherwise safety feature into a frightening and dangerous nightmare." The lawsuit was filed Aug. 24 in federal court for the Northern District of California.
The lawsuit seeks a class action for all U.S. owners or renters of Teslas who suffer from sudden and unexpected braking defects. Tesla did not immediately respond to a request for comment.
In February, the U.S. National Highway Traffic Safety Administration (NHTSA) launched an investigation into 416,000 Tesla vehicles following reports of unexpected braking in Tesla's Autopilot system.
The lawsuit alleges Tesla fraudulently concealed the safety risks associated with Autopilot, violated its warranties, profited unfairly from Autopilot, and violated California's unfair competition laws.
The lawsuit seeks compensatory and punitive damages from Tesla for vehicle repair costs and loss of vehicle value, as well as refunds for increased costs due to the Autopilot feature.
